Agreement to Our Legal Terms
We are Pcific Marketplaces Limited, company number 16802447, doing business as PCIFIC ("PCIFIC", "Company", "we", "us", or "our"). We are registered in England and Wales and our registered office is at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.
We operate the website https://pcific.co.uk, together with any related websites, applications, hosted pages, checkout flows, messaging tools, support channels, verification tools, AI-assisted features, seller tools, review tools, reporting tools, and other services that refer or link to these Terms of Service (the "Terms") (collectively, the "Services").
These Terms form a legally binding agreement between you and Pcific Marketplaces Limited concerning your access to and use of the Services. By accessing or using any part of the Services, creating an account, listing an item, placing an order, sending a message, submitting content, or using any seller, buyer, support, verification, or AI-assisted tool, you confirm that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, you must not access or use the Services.
We may publish additional rules, guidelines, programme terms, policies, help-centre pages, or checkout disclosures that apply to particular features, categories, promotions, fees, buyer protection, seller tools, shipping methods, verification checks, or support processes. Where those additional terms expressly say that they apply, they form part of these Terms. If there is a direct conflict, the more specific terms for the relevant feature or transaction will apply to that feature or transaction.
The Services are intended only for users who are at least 18 years old and legally capable of entering into contracts. By using the Services, you confirm that you meet those requirements.
We recommend that you save or print a copy of these Terms for your records.
Our Services and Marketplace Role
PCIFIC is a UK-based online marketplace focused on electronics, components, accessories, refurbished devices, spare parts, repair-related goods, reuse, resale, and sustainability use cases.
Unless we expressly say otherwise for a specific item, service, programme, or feature, PCIFIC acts as a disclosed marketplace intermediary and, where relevant, a disclosed collection agent for the seller. PCIFIC is not the principal retailer, merchant of record, seller, buyer, reseller, repairer, refurbisher, manufacturer, importer, exporter, carrier, insurer, tax adviser, or payment provider for third-party listings.
For avoidance of doubt, where a third-party item is sold through the Services, any contract of sale is formed directly between the buyer and the seller. PCIFIC is not a party to that contract, and title passes directly from the seller to the buyer in accordance with the seller's terms and applicable law.
In most third-party marketplace transactions:
- PCIFIC acts only as a disclosed intermediary and, where applicable, collection agent for the seller;
- the seller is responsible for the legality, safety, ownership, title, authenticity, condition, accuracy, availability, pricing, delivery promises, and description of the listing;
- the buyer is responsible for reviewing the listing, seller information, delivery options, fees, and transaction details before buying;
- PCIFIC provides marketplace functionality, checkout workflows, messaging, moderation tools, support tools, reporting tools, AI-assisted tools, verification signals, payment integrations, shipping integrations, and operational support; and
- PCIFIC does not inspect every item, verify every statement, authenticate every product, guarantee every transaction, or adjudicate every dispute between users.
Where PCIFIC expressly states that PCIFIC itself is the seller, direct service provider, or contracting party for a particular item, programme, or paid service, the relevant contract will be between you and PCIFIC for that limited item, programme, or service only.
Some Services may provide information, suggestions, summaries, search results, rankings, category recommendations, pricing suggestions, verification signals, badges, AI-assisted outputs, or support guidance. These features are designed to help users, but they are not guarantees and may be inaccurate, incomplete, delayed, unavailable, or unsuitable for your circumstances. You remain responsible for checking important information before relying on it, publishing it, buying an item, selling an item, shipping an item, or taking any other action.
The Services are operated from the United Kingdom. If you access or use the Services from outside the United Kingdom, you do so on your own initiative and are responsible for complying with local laws that apply to you.
Eligibility and Accounts
You may need to register an account to use some or all of the Services.
You agree that all information you provide to us, to other users, to payment providers, to shipping providers, to verification providers, or through the Services will be true, accurate, current, and complete. You must keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account, except to the extent caused by our failure to use reasonable security measures.
You must not:
- create an account using false, misleading, incomplete, or unauthorised information;
- impersonate another person or business;
- use another user's account without permission;
- sell, transfer, gift, lend, or share your account;
- create a new account to avoid a restriction, suspension, ban, investigation, debt, chargeback, unresolved dispute, or verification requirement;
- use the Services if you are subject to sanctions or are prohibited from doing so by law; or
- use the Services for any unlawful, fraudulent, harmful, or misleading purpose.
We may refuse, reclaim, or require you to change a username, display name, profile field, shop name, listing name, or other account identifier if we reasonably believe it is misleading, impersonates another person or business, infringes rights, is offensive, creates risk, or breaches these Terms.
We may request identity, age, trader-status, business, tax, VAT, bank, payout, address, shipping, product, ownership, or compliance information before or after allowing you to use particular features. If you do not provide requested information, or if we reasonably consider the information incomplete, inconsistent, unreliable, or misleading, we may restrict your account, listings, transactions, messages, support access, or payouts.
Seller Status: Private Sellers and Trader Sellers
PCIFIC supports transactions involving private sellers and sellers who act in the course of business. Your legal duties and your buyers' rights can differ depending on your seller status. Unless we expressly approve otherwise in writing, sellers must be established in the United Kingdom and must keep a valid UK trading address and payout method on file. We may reclassify seller status based on activity, volume, frequency, product type, sourcing, stock levels, marketing, business registration, VAT position, profit motive, and other evidence, and we may require trader onboarding once activity suggests you are acting in the course of business.
A private seller is generally an individual selling their own personal goods occasionally and not in the course of business. A trader seller is generally a person or business selling in the course of a trade, business, craft, or profession. The label you choose is not conclusive. We may consider your activity, volume, frequency, product type, sourcing, stock levels, marketing, business registration, VAT position, profit motive, and other evidence.
If you are a seller, you must:
- accurately state whether you are acting as a private seller or as a trader seller where the Services request that information;
- promptly provide evidence we reasonably request about your identity, seller status, business details, establishment, tax, VAT, payout entitlement, ownership of goods, product safety, or legal compliance;
- keep your seller information accurate and current;
- not misrepresent yourself as a private seller to avoid consumer-law, tax, VAT, disclosure, or platform requirements; and
- not use multiple accounts, relatives, employees, aliases, or business structures to avoid seller-status checks or marketplace limits.
If we reasonably believe that you are acting as a trader seller, we may require you to:
- identify yourself as a trader or business;
- provide your legal name, business name, company number, VAT number, trade register details, geographic address, contact details, complaint-handling details, and any other legally required pre-contract information;
- make business identity details visible to buyers before purchase, including the legal name and geographic trading address, and VAT number where applicable;
- provide cancellation, returns, warranty, delivery, complaint, and after-sales information where required;
- correct listings, profile information, checkout information, or support information;
- stop selling until required information is provided; or
- accept supplemental seller, trader, or programme terms.
Trader sellers are solely responsible for complying with all laws that apply to their sales, including consumer information, cancellation, returns, refunds, product safety, advertising, tax, VAT, environmental, import, export, sanctions, intellectual-property, and business-disclosure rules. PCIFIC's own commissions, seller fees, and other platform charges are separate supplies by PCIFIC to the relevant user and may be subject to VAT where applicable.
Private sellers must still ensure that their listings are lawful, truthful, safe, and not misleading. A private seller must not sell items they do not own, items they have no right to sell, stolen goods, counterfeit goods, unsafe goods, recalled goods, or items that do not match the listing description.
Listings, Products, and Electronics-Specific Requirements
The Services may display or facilitate access to physical products, spare parts, accessories, bundles, services, support information, verification information, AI-assisted listing drafts, condition information, reviews, and operational information relating to listed items.
Unless a listing or page expressly states that PCIFIC is the seller, products listed through the Services are offered by third-party sellers.
If you list an item, you represent and warrant that:
For any third-party sale, the seller is responsible for issuing any invoice or tax invoice required by law or by agreement. If PCIFIC generates an order confirmation, receipt, or similar document, it will be clearly labelled as issued by PCIFIC as disclosed agent for the seller and not as a principal retailer.
- you own the item or have full legal authority to sell it;
- the item is in your possession or under your control and available for sale, unless PCIFIC has expressly approved a different arrangement;
- the listing title, description, category, attributes, photos, price, condition, defects, compatibility, included items, missing items, shipping details, returns information, and seller information are accurate and not misleading;
- you have disclosed all material defects, repairs, refurbishments, modifications, replacement parts, battery issues, lock issues, missing accessories, compatibility limits, region locks, network locks, software locks, or other facts a buyer would reasonably consider important;
- the item is lawful to sell, ship, export, import, and use in the relevant locations;
- the item complies with applicable product-safety, electrical-safety, environmental, waste-electrical, battery, charger, radio-equipment, consumer, advertising, and intellectual-property laws;
- the item is not stolen, counterfeit, recalled, unsafe, subject to an unresolved safety warning, subject to an undisclosed finance agreement, leased, blocked, blacklisted, activation locked, mobile-device-management locked, reported lost or stolen, marked "not for resale", a pre-production unit, or otherwise not legally saleable;
- any serial number, IMEI, ESN, model number, part number, capacity, colour, grade, battery health, repair history, refurbishment status, or compatibility claim is accurate to the best of your knowledge; and
- you will promptly remove or update the listing if the item sells elsewhere, becomes unavailable, changes condition, is found to be non-compliant, or is affected by a recall, safety issue, rights complaint, or ownership dispute.
For electronics, devices, components, batteries, chargers, and spare parts, you must take particular care. You must not list or sell:
- phones, tablets, watches, laptops, consoles, or other connected devices with uncleared activation locks, iCloud locks, Google locks, MDM locks, carrier locks that are not clearly disclosed, unpaid finance, leasing restrictions, blocked IMEI/ESN status, blacklisting, or unresolved lost/stolen reports;
- devices that are not fully functional unless every functional issue is clearly disclosed and the item is listed in a category or condition state that allows such sales;
- batteries, power supplies, chargers, cables, adapters, or accessories that are damaged, swollen, frayed, counterfeit, uncertified, unsafe, recalled, or unsuitable for the item;
- modified, rooted, jailbroken, firmware-altered, region-altered, repaired, refurbished, parts-swapped, or water-damaged devices unless the modification or condition is allowed by PCIFIC policy and clearly disclosed;
- products that have been recalled, banned, withdrawn, or made subject to a safety notice unless resale is lawful and all required corrective action has been completed; or
- parts or tools intended to bypass security, theft-prevention, safety, emissions, network, licensing, payment, digital-rights, or access-control systems.
If you cross-list an item on another marketplace or sell through another channel, you remain fully responsible for promptly removing or updating the PCIFIC listing if the item is no longer available. If the same item sells twice, you are responsible for cancelling or refunding the affected buyer and for any losses, fees, disputes, or support issues caused by your failure to manage availability.
PCIFIC may require proof of ownership, provenance, purchase history, import status, conformity, repair, refurbishment, safety, recall, certification, serial, IMEI, battery, or verification information at any time. We may remove, hide, restrict, or pause listings where information is missing, inconsistent, unreliable, or risky.
Verification, IMEI, Serial, Safety, and Authenticity Signals
PCIFIC may provide verification workflows, badges, warnings, checks, duplicate-listing signals, serial-number checks, IMEI checks, blocked-device checks, authenticity signals, compliance indicators, trust signals, seller-profile signals, or similar tools.
These signals are screening and information tools only. They do not guarantee title, ownership, authenticity, legal right to sell, non-infringement, condition, safety, battery health, recall status, network compatibility, future functionality, future unlock status, or regulatory compliance.
If you submit serial numbers, IMEIs, photos, invoices, proof of purchase, repair records, diagnostic results, ownership evidence, or other verification materials, you confirm that the information is accurate, that you have the right to provide it, and that we may use it to operate, secure, verify, moderate, support, and enforce the marketplace.
We may share verification-related information with service providers, payment providers, shipping providers, rights holders, law enforcement, regulators, fraud-prevention partners, or affected users where legally permitted or required and where reasonably necessary to investigate fraud, safety, rights, ownership, payment, or compliance concerns.
We may refuse, withdraw, change, or qualify a badge, warning, verification status, or search signal at any time if new information becomes available or if we reasonably consider it necessary to protect users, comply with law, or manage risk.
Purchases, Payment, Buyer Protection, and Fees
When you buy an item from a third-party seller through the Services, the contract for the sale of that item is formed directly between you and the seller, not between you and PCIFIC, unless we expressly state otherwise. PCIFIC acts only as the seller's disclosed intermediary and, where relevant, collection agent. Title passes directly from the seller to the buyer in accordance with the seller's terms and applicable law.
By placing an order, you agree to provide current, complete, and accurate purchase, billing, shipping, contact, and account information. You authorise the relevant payment provider to charge your selected payment method for the item price, shipping or delivery charges, taxes, duties, marketplace fees, protection fees, service fees, and any other charges clearly disclosed before you place the order.
If PCIFIC or a payment provider temporarily receives funds relating to a third-party sale, it does so solely as the seller's disclosed collection agent and not as beneficial owner of those funds, except to the extent necessary to process, hold, reverse, refund, or remit the payment in accordance with these Terms, the applicable payment-provider terms, and applicable law.
All amounts shown through the Services are in GBP unless stated otherwise.
PCIFIC currently advertises standard marketplace listings to sellers as carrying 0% seller fees, unless separate seller terms, programme terms, checkout disclosures, or a specific feature state otherwise. PCIFIC currently discloses a buyer-paid Buyer Protection Fee model under which buyers pay a 4.5% protection charge plus a fixed GBP 2.00 service fee per order or transaction, subject to any clearer or more specific disclosure shown before the order is placed.
PCIFIC does not currently offer a general recurring consumer subscription under these Terms unless a separate subscription, membership, or paid-service offer expressly says otherwise and provides its own specific billing terms.
Payments, refunds, reversals, chargebacks, holds, seller payouts, wallet balances, bank transfers, card payments, fraud checks, sanctions checks, and identity checks may be handled by third-party payment providers. Your use of those payment services may be subject to separate payment-provider terms. We are not responsible for delays, refusals, freezes, reversals, or other actions taken by a payment provider where those actions are required or permitted by law, payment-network rules, fraud controls, sanctions rules, risk controls, or the provider's terms.
We and our payment providers may refuse, block, reverse, refund, cancel, or place a hold on a transaction, payment method, refund, or payout where reasonably necessary for fraud prevention, sanctions screening, legal compliance, security, risk management, card-network rules, payment-provider requirements, user protection, suspected breaches of these Terms, or suspected misuse of the Services.
Buyer Protection
Where PCIFIC offers Buyer Protection for a transaction, it applies only as described in these Terms, the checkout disclosures, and any separate Buyer Protection policy we publish. Buyer Protection is not insurance, a warranty, a guarantee of every transaction, or a replacement for statutory rights.
Unless the checkout or a separate policy says otherwise, Buyer Protection applies only where the buyer completes the transaction through PCIFIC's integrated checkout and payment flow and complies with the applicable reporting and evidence requirements.
Buyer Protection may assist where:
- the item does not arrive within the estimated delivery period or is not made available for an agreed collection or locker-style handoff;
- the item is significantly not as described in the listing text, required attributes, or photos;
- the wrong item is sent;
- the item is counterfeit, stolen, blocked, activation locked, or otherwise materially non-compliant in a way not disclosed in the listing;
- the item is damaged in transit and the buyer provides sufficient evidence; or
- another issue is expressly covered by a policy or checkout disclosure.
Buyer Protection does not usually cover:
- purchases made outside PCIFIC's integrated checkout;
- cash, bank-transfer, cryptocurrency, payment-link, gift-card, or off-platform payments;
- buyer remorse, change of mind, or preference-based returns where no statutory right or seller policy applies;
- minor differences that do not materially affect the item;
- issues clearly disclosed in the listing before purchase;
- damage caused by the buyer, attempted repair, improper use, installation, modification, or failure to follow instructions;
- missed deliveries, failed collections, wrong addresses, or return failures caused by the buyer;
- prohibited or restricted items;
- claims submitted late without a legally valid reason;
- items altered, repaired, resold, discarded, or returned incomplete before PCIFIC or the seller can inspect the issue; or
- disputes where the buyer does not provide reasonably requested evidence.
Unless the checkout or a separate policy states a different period, buyers must report delivery, damage, counterfeit, wrong-item, or significant-not-as-described issues through the Services within 48 hours after delivery, collection, or availability for collection is recorded, or as soon as reasonably possible where applicable law requires a longer period. Late reports may be declined for Buyer Protection purposes, but this does not remove any non-excludable statutory rights you may have against a trader seller.
If no timely issue is reported, we may treat the transaction as complete for platform-protection and payout purposes and release or instruct release of funds to the seller, subject to payment-provider rules, fraud checks, chargeback risk, legal obligations, and unresolved safety or compliance concerns.
If a Buyer Protection claim is opened, the buyer and seller must cooperate in good faith and provide requested evidence promptly. Evidence may include photos, video, packaging, tracking information, carrier records, serial or IMEI information, diagnostic reports, repair records, invoices, proof of posting, proof of delivery, or other materials relevant to the dispute.
We may decide, in our reasonable discretion and subject to applicable law, whether to refund, partially refund, require return, release funds, hold funds, cancel the transaction, restrict an account, remove a listing, or take other platform action. We may rely on tracking events, payment provider information, shipping provider information, user evidence, verification data, risk signals, and support history.
Any Buyer Protection refund may include or exclude item price, shipping, Buyer Protection Fee, service fee, return postage, or other amounts depending on the applicable policy, legal requirements, payment-provider rules, and the circumstances of the claim.
Nothing in this section limits any non-excludable statutory rights you may have.
Shipping, Delivery, Collection, and Risk
Sellers are responsible for accurately stating available shipping, collection, handling time, delivery, return, and location information. Sellers must package items safely and lawfully, use reasonable care when shipping, and comply with carrier rules, battery rules, hazardous-material rules, customs rules, export rules, import rules, and any product-specific shipping restrictions.
Buyers are responsible for providing accurate shipping, contact, and collection information and for collecting items within carrier, locker, store, or seller time limits.
Where PCIFIC provides or integrates shipping labels, service-point delivery, locker delivery, collection options, or carrier services, those services may be supplied by third parties and may be subject to separate carrier terms. PCIFIC does not guarantee carrier availability, delivery times, scan accuracy, collection availability, customs clearance, or loss/damage decisions by carriers.
Unless a separate policy says otherwise:
- sellers should use tracked shipping where available and should keep proof of posting and dispatch;
- risk of loss or damage in transit remains with the seller until the item is delivered to the buyer or collected by the buyer, unless mandatory law or a specific checkout disclosure says otherwise;
- buyers should inspect delivered or collected items promptly and keep packaging until any issue is resolved;
- a delivery scan, collection scan, locker-ready event, proof of handoff, or carrier record may be used as evidence in a dispute;
- if an item is returned to sender because of an incorrect address, failed collection, missed delivery, or buyer refusal, the buyer may be responsible for additional shipping costs unless applicable law or a seller policy says otherwise;
- if an item is damaged in transit, the buyer and seller must preserve packaging and cooperate with evidence requests; and
- if a return is required, the item must be returned in the condition received, with all included parts, accessories, packaging, and evidence reasonably required for the return.
For batteries, chargers, devices, and electronics, sellers must ensure that packaging and shipping methods are suitable and lawful. Items with swollen batteries, damaged batteries, exposed wiring, unsafe chargers, or other safety risks must not be shipped unless shipment is lawful and all required safety steps are followed.
Returns, Cancellations, Refunds, and Disputes
Return, cancellation, refund, repair, replacement, rejection, and chargeback rights depend on the nature of the seller, the item, the transaction, the seller policy, any Buyer Protection policy, and the law that applies.
If you buy from a trader seller
Where the seller is acting as a trader or business, your rights may include statutory rights under applicable consumer law, including rights relating to items not as described, not of satisfactory quality, unfit for purpose, unsafe, or sold in breach of mandatory pre-contract information requirements. Separate cancellation rights may also apply to certain distance contracts, subject to legal exceptions.
Trader sellers are responsible for providing cancellation information, returns information, refund information, complaint information, and any legally required forms or instructions. Trader sellers must honour non-excludable consumer rights.
If you buy from a private seller
Where the seller is a private individual rather than a trader, your legal rights are usually more limited. For example, you may generally expect the item to match the seller's description and for the seller to have the right to sell it, but you may not receive the same cancellation rights, returns rights, or consumer remedies that usually apply when buying from a trader.
PCIFIC's role in returns and disputes
Unless PCIFIC expressly says otherwise, PCIFIC is not the seller and does not provide a blanket marketplace-wide return promise for every third-party transaction. However, PCIFIC may:
- provide tools for buyer-seller communication;
- provide support, reporting, escalation, and dispute tools;
- apply Buyer Protection where available and eligible;
- request evidence from buyers, sellers, carriers, payment providers, or verification providers;
- remove or restrict listings;
- suspend or restrict accounts;
- hold or delay payouts where permitted;
- report serious issues to law enforcement, regulators, carriers, payment providers, rights holders, or other appropriate third parties; or
- apply any separate marketplace policy that we clearly publish.
Any separate posted policy or programme will supplement, not remove, any non-excludable statutory rights.
If you open a dispute, you must act honestly, provide accurate evidence, preserve relevant items and packaging, respond to reasonable requests, and avoid altering, repairing, discarding, reselling, or returning items except as instructed or permitted. False claims, fabricated evidence, altered photos, manipulated tracking, abusive chargebacks, or bad-faith disputes may lead to denial of Buyer Protection, account restrictions, payment holds, recovery action, and reporting to relevant third parties where appropriate.
If you are a seller, you must respond to disputes, return requests, support requests, and evidence requests within the deadlines we provide. Failure to respond may result in a refund, payout hold, listing restriction, account restriction, or other platform action based on the available evidence.
Seller Verification, Tax, VAT, and Payout Compliance
We may request, collect, verify, retain, use, and share information reasonably necessary to operate the marketplace, comply with law, manage risk, prevent fraud, process payments, support users, investigate disputes, or meet tax, VAT, reporting, anti-money-laundering, sanctions, product-safety, consumer-protection, or digital-platform obligations.
This information may include:
- full legal name, date of birth, address, email address, phone number, and identity documents;
- business name, company number, trade register information, VAT number, tax references, and establishment information;
- bank account, payout, payment, card, or wallet information;
- proof of address, proof of trading status, invoices, stock records, purchase records, import records, customs records, repair records, refurbishment records, serial numbers, IMEIs, and proof of title;
- transaction, listing, shipping, support, review, and dispute records; and
- information required by HMRC, payment providers, regulators, law enforcement, courts, carriers, insurers, or other legally authorised parties.
Sellers are responsible for their own taxes, VAT, duties, customs declarations, income reporting, business registrations, invoices, records, and professional advice. PCIFIC does not provide tax, legal, accounting, import, export, product-safety, or financial advice. Where PCIFIC or a payment provider receives funds relating to a third-party sale, it receives those funds solely as disclosed collection agent for the seller and may process, hold, reverse, refund, remit, or reconcile those funds in accordance with these Terms, the relevant payment-provider terms, and applicable law.
Where law requires PCIFIC or a payment provider to collect, verify, report, withhold, or share seller or transaction information, you agree to provide the required information and cooperate promptly. If you do not, we may restrict listings, pause transactions, delay payouts, withhold amounts where permitted, close your account, or take other reasonable steps.
We may rely on information you provide, but we are not obliged to verify every statement or document. If we reasonably believe information is false, incomplete, inconsistent, expired, misleading, or no longer reliable, we may require corrected information and restrict your use of the Services until the issue is resolved.
Prohibited and Restricted Activities
You may use the Services only for their intended lawful marketplace purposes and in accordance with these Terms and any applicable policies.
You must not:
- list, offer, request, sell, buy, ship, promote, or facilitate any item that is unlawful, stolen, counterfeit, fraudulent, unsafe, recalled, infringing, restricted, prohibited, or not legally saleable;
- list or sell items you do not own, do not possess, cannot lawfully sell, or cannot lawfully deliver;
- list or sell devices with blocked IMEI/ESN status, activation locks, unpaid finance, lease restrictions, lost/stolen reports, MDM locks, unreleased prototypes, "not for resale" markings, or other undisclosed restrictions;
- misrepresent condition, grade, repair history, refurbishment status, battery health, serial number, IMEI, compatibility, included items, ownership, provenance, authenticity, safety, warranty, recall status, trader status, delivery time, or return rights;
- list unsafe chargers, frayed cables, swollen batteries, damaged batteries, hazardous materials, recalled goods, or items that cannot be safely or lawfully shipped;
- list or sell counterfeit goods, unauthorised replicas, infringing parts, pirated software, bypass tools, lock-circumvention tools, stolen credentials, personal data, payment cards, identity documents, malware, surveillance tools, or goods designed primarily to commit or conceal unlawful activity;
- list or sell age-restricted, regulated, dangerous, weapon-related, drug-related, medical, financial, animal-related, offensive, hateful, sexually explicit, or otherwise sensitive items unless expressly allowed by PCIFIC policy and lawful in all relevant locations;
- use the Services to launder money, evade sanctions, evade taxes, commit payment fraud, commit customs fraud, avoid product-safety rules, or mislead regulators, carriers, payment providers, or users;
- move, solicit, encourage, or complete a transaction outside PCIFIC to avoid fees, Buyer Protection, payment controls, tax reporting, safety controls, or evidence trails;
- submit false reviews, fake reviews, incentivised reviews without disclosure, retaliatory reviews, false reports, false support requests, false verification data, false counter-notices, fabricated evidence, or manipulated photos, videos, tracking, serial numbers, IMEIs, invoices, or documents;
- misuse support channels, including by spamming, harassing, threatening, abusing staff or users, repeatedly opening bad-faith tickets, or knowingly making false allegations;
- scrape, crawl, harvest, mine, copy, monitor, train models on, bulk download, or systematically retrieve data, listings, prices, images, reviews, user information, or platform content without our written permission;
- use bots, scripts, automation, APIs, browser extensions, or third-party software to access, monitor, manipulate, list, buy, message, review, rank, or interact with the Services except where we expressly allow it;
- interfere with, disrupt, overload, probe, scan, test, bypass, reverse engineer, decompile, compromise, or circumvent any security, fraud, verification, moderation, payment, search, ranking, listing, support, or access-control system;
- upload malware, viruses, malicious code, tracking tools, or harmful content;
- impersonate another person or business, misrepresent affiliation, conceal conflicts of interest, or coordinate with others to manipulate prices, availability, search results, reviews, support outcomes, disputes, or marketplace policies;
- harass, threaten, defame, bully, discriminate against, exploit, spam, blackmail, extort, or otherwise harm another user, PCIFIC staff, or a third party;
- publish personal, confidential, private, sensitive, or financial information about another person without lawful authority;
- use the Services to promote hatred, violence, terrorism, extremism, self-harm, illegal activity, or abuse;
- relist, relabel, alter, or reintroduce goods, content, accounts, or listings removed for safety, rights, counterfeit, theft, fraud, legal, or compliance reasons without our written approval; or
- use the Services in any way that breaches these Terms, applicable law, third-party rights, payment-provider rules, carrier rules, or any policy we publish.
We may remove content, hide listings, block transactions, cancel transactions, hold funds, delay payouts, issue warnings, restrict features, suspend accounts, terminate accounts, report conduct, or take other action where we reasonably believe prohibited or restricted activity has occurred.
User Content and Listing Content
The Services may allow you to create, upload, submit, publish, display, send, receive, or otherwise make available content, including listing text, photos, videos, profile information, messages, reviews, reports, support materials, verification materials, product data, documents, and other materials ("User Content").
You retain ownership of your User Content, subject to the licence below.
You are responsible for your User Content. By making User Content available through the Services, you represent and warrant that:
- you own it or have all rights, licences, consents, and permissions needed to provide it and allow us to use it as described in these Terms;
- it is accurate to the best of your knowledge and not misleading in any material respect;
- it does not infringe any third-party intellectual-property, privacy, publicity, confidentiality, consumer, product-safety, or other rights;
- it does not contain unlawful, hateful, discriminatory, harassing, threatening, obscene, exploitative, sexually explicit, violent, terrorist, extremist, fraudulent, or harmful material;
- it does not contain malware, malicious code, unauthorised tracking tools, or harmful technical material;
- where it identifies another person, you have any consent or lawful basis required to provide it;
- it does not include false evidence, fabricated ownership claims, false safety claims, false verification claims, altered serial or IMEI information, or misleading product claims; and
- it complies with these Terms and all applicable law.
When you make User Content available through the Services, you grant PCIFIC a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, store, reproduce, format, adapt, display, perform, communicate, distribute, translate, moderate, analyse, and otherwise use that User Content to the extent reasonably necessary to:
- operate, provide, secure, verify, moderate, and improve the Services;
- display and promote the relevant listing, profile, review, message, transaction, support, or report context;
- operate search, ranking, recommendations, category, verification, fraud, safety, AI-assisted, support, and analytics features;
- investigate complaints, enforce these Terms, manage disputes, prevent fraud, and protect users;
- comply with legal, tax, VAT, payment, product-safety, law-enforcement, regulatory, and reporting obligations; and
- create backups and maintain business continuity.
This licence continues for as long as reasonably necessary for those purposes. Where you delete User Content, we will stop using it publicly within a reasonable period, but we may retain copies where necessary for backups, legal compliance, tax compliance, VAT compliance, payment processing, fraud prevention, safety, evidence preservation, dispute handling, enforcement, or legitimate business records.
Nothing in this section transfers ownership of your User Content to PCIFIC.
We do not routinely pre-screen every item of User Content and are not obliged to do so. However, we may review, moderate, remove, restrict, redact, disable, relabel, or refuse User Content where reasonably necessary to operate the Services, enforce these Terms, respond to reports or legal requests, protect users, comply with law, or manage risk.
AI-Assisted Features and Bulk Import Tools
PCIFIC may provide AI-assisted search, AI-assisted listing creation, AI-assisted categorisation, AI-assisted support, pricing suggestions, condition suggestions, product summaries, compatibility suggestions, conversation summaries, draft replies, bulk upload tools, CSV import tools, eBay CSV import flows, marketplace-import tools, image parsing, and other automation features.
These tools are assistive only. They may generate inaccurate, incomplete, outdated, unsafe, misleading, duplicated, biased, non-compliant, or unsuitable output. They may misread photos, miss defects, choose the wrong category, misstate condition, invent specifications, omit accessories, misprice items, misunderstand repair history, or import stale third-party marketplace text.
If you use AI-assisted features or bulk import tools, you remain fully responsible for reviewing, correcting, and approving all final content before publication, messaging, support submission, shipping, or sale.
In particular, sellers remain responsible for:
- checking titles, descriptions, photos, categories, attributes, condition, grade, price, shipping, returns, safety, compatibility, included items, missing items, serial numbers, IMEIs, battery health, repair history, and refurbishment status;
- removing stale references to other marketplaces, old promotions, old shipping terms, old return policies, broken links, or incompatible third-party text;
- ensuring the listing complies with law, these Terms, and any PCIFIC policy;
- ensuring AI-generated or imported content does not infringe rights or mislead buyers; and
- correcting errors before the listing goes live or before a buyer relies on the content.
You must not use AI-assisted tools to create unlawful, fraudulent, infringing, unsafe, hateful, abusive, misleading, spam, fake-review, fake-report, or policy-evading content.
PCIFIC may monitor, log, review, restrict, or disable AI-assisted and bulk import tools for safety, fraud prevention, quality control, legal compliance, cost control, or abuse prevention.
Reviews and Ratings
The Services may allow users to post ratings, reviews, feedback, comments, trust signals, or other review information about users, listings, items, support interactions, or transactions.
Reviews must be genuine, honest, and based on a real experience. You must not:
- post fake, fabricated, misleading, manipulated, or duplicate reviews;
- post a review for yourself, your own business, your own listing, a competitor, a family member, an employee, or another person where there is an undisclosed conflict of interest;
- buy, sell, trade, request, pressure, incentivise, or coordinate reviews unless clearly allowed and disclosed in accordance with law and PCIFIC policy;
- post retaliatory reviews, blackmail reviews, extortionate reviews, or reviews intended to force an outcome unrelated to the reviewed transaction;
- include private, sensitive, confidential, defamatory, unlawful, discriminatory, abusive, or irrelevant material;
- manipulate review timing, ratings, counts, rankings, summaries, or seller reputation; or
- use reviews to advertise, spam, link off-platform, or interfere with another user's business.
We use reasonable and proportionate measures designed to prevent and remove fake reviews, concealed incentivised reviews, review manipulation, and false or misleading review information. We may investigate, reject, remove, suppress, relabel, not publish, discount, exclude, or recalculate reviews, ratings, counts, rankings, or summaries where we reasonably suspect fraud, manipulation, conflict of interest, abuse, incentivisation without disclosure, legal risk, or breach of these Terms.
We may issue warnings, suspend review privileges, restrict accounts, or take other action for review abuse.
Reviews and ratings reflect user opinions, not necessarily PCIFIC's views. We do not guarantee the accuracy of any review or rating.
Messaging, Support Tickets, Reports, and Evidence
The Services may allow users to message each other, contact support, open tickets, report listings, report users, provide evidence, preview replies, escalate disputes, or receive support guidance.
You must use messaging, support, reporting, and evidence tools lawfully, honestly, and in good faith.
You must not use these tools to:
- move transactions off-platform;
- exchange payment details for off-platform payment;
- send spam, advertising, phishing, malware, scams, or unsolicited promotions;
- harass, threaten, abuse, bully, discriminate against, blackmail, extort, or intimidate another person;
- submit false reports, false claims, false evidence, manipulated evidence, or bad-faith tickets;
- repeatedly open duplicate or abusive tickets;
- interfere with another user's transaction, listing, reputation, or business;
- publish personal, sensitive, or confidential information without lawful authority; or
- avoid moderation, payment, shipping, verification, tax, VAT, safety, or support controls.
Support tickets and reports should include accurate details and relevant evidence. You must preserve evidence while a dispute, report, safety issue, chargeback, rights complaint, or support ticket is open.
PCIFIC may use support, report, message, transaction, listing, verification, payment, shipping, and review information to investigate issues and enforce these Terms. We may share information with affected users, service providers, carriers, payment providers, rights holders, regulators, law enforcement, courts, or other appropriate third parties where legally permitted or required and reasonably necessary.
Support guidance, support summaries, AI-assisted support replies, and dispute outcomes are operational tools. They are not legal advice and do not remove non-excludable statutory rights.
Notice-and-Action, Rights Holder Reports, and Safety Reports
If you believe that a listing, item, review, message, account, or other User Content involves counterfeit goods, stolen goods, IP infringement, unsafe goods, recalled goods, unlawful content, fraud, impersonation, personal-data misuse, or another serious risk, you may report it through the reporting tools or by contacting us.
A useful report should include:
- your name and contact details;
- the listing, user, message, order, review, or content you are reporting;
- the legal, safety, rights, or policy basis for the report;
- evidence supporting the report;
- if you are a rights holder or authorised representative, evidence of ownership or authority; and
- a statement that the information you provide is accurate to the best of your knowledge.
When we receive a report, notice, complaint, or other information alleging risk, we may take temporary or permanent action before, during, or after an investigation. That action may include removing or disabling content, hiding a listing, pausing a transaction, holding a payout, preserving evidence, requesting a response, requesting a counter-notice, warning a user, restricting an account, terminating an account, reporting to third parties, or declining to restore content where risk remains unresolved.
We may reject reports that are incomplete, abusive, fraudulent, bad faith, unsupported, or outside our role as a marketplace operator.
If your content or account is affected by a report, we may give you an opportunity to respond where appropriate. We may decline to provide details or an opportunity to respond where doing so would create legal, safety, fraud, security, investigative, confidentiality, or regulatory risk, or where you have repeatedly breached these Terms.
We do not undertake to adjudicate every dispute between users, rights holders, manufacturers, carriers, payment providers, or third parties. We may make platform decisions based on the information available to us.
Repeat infringers, repeat counterfeit sellers, repeat safety-risk sellers, repeat stolen-goods sellers, and users who repeatedly submit false reports may have their access restricted or terminated.
Search, Ranking, Recommendations, and Platform Signals
The Services may use search, ranking, recommendation, category, sorting, filtering, promotion, personalisation, fraud, trust, safety, verification, availability, location, delivery, price, quality, review, seller-performance, and AI-assisted signals.
Search results, rankings, recommendations, badges, warnings, suggestions, and other platform signals may change over time. They may be affected by factors such as query terms, category, listing quality, item availability, price, delivery options, location, seller response history, seller reliability, reviews, verification status, buyer preferences, policy compliance, risk signals, fraud signals, safety signals, payment status, and technical performance.
PCIFIC may also remove, demote, hide, restrict, relabel, or qualify listings, users, reviews, or content where reasonably necessary to enforce these Terms, comply with law, protect users, manage risk, or improve marketplace quality.
Search, ranking, recommendations, AI outputs, badges, and verification signals are not guarantees that a product is authentic, lawful, safe, compatible, suitable, available, correctly priced, or accurately described.
If PCIFIC offers paid promotion or sponsored placement in future, the relevant placement may be labelled or governed by supplemental terms or disclosures.
Third-Party Services
The Services may contain links to, integrate with, or rely on third-party websites, content, software, payment providers, shipping providers, identity providers, verification providers, analytics providers, support tools, AI providers, fraud-prevention services, communication tools, or other services ("Third-Party Services").
Third-Party Services are not controlled by PCIFIC unless expressly stated. We are not responsible for their availability, accuracy, legality, security, performance, decisions, terms, fees, privacy practices, outages, delays, or errors.
Your use of Third-Party Services may be subject to separate terms and policies between you and the third party. If you leave the Services or use a Third-Party Service through the Services, these Terms do not replace the third party's own terms.
Service Management, Restrictions, Suspension, and Appeals
We may, but are not obliged to:
- monitor the Services for compliance with these Terms;
- investigate suspected fraud, abuse, policy breaches, safety issues, rights issues, payment risk, tax risk, VAT risk, support abuse, review abuse, or unlawful conduct;
- remove, disable, edit, restrict, relabel, or refuse listings, reviews, messages, support submissions, reports, User Content, accounts, or transactions;
- block, cancel, refund, reverse, pause, or limit transactions;
- delay, hold, restrict, or release payouts where permitted;
- request information, documents, explanations, counter-notices, or evidence;
- report relevant information to law enforcement, regulators, rights holders, payment providers, carriers, tax authorities, fraud-prevention partners, or other appropriate third parties where legally permitted or required; and
- take steps we reasonably consider necessary to protect users, third parties, PCIFIC, and the Services.
We may suspend, restrict, terminate, or refuse your access to the Services, or remove any listing, content, review, message, or account, if we reasonably believe that:
- you have breached these Terms or another applicable policy;
- your use of the Services creates legal, regulatory, safety, security, tax, VAT, payment, product-safety, rights, fraud, or reputational risk;
- you have failed to complete or pass identity, age, trader-status, business, tax, VAT, payout, product, ownership, or compliance checks;
- your listing, item, content, account, payment method, shipping activity, or support activity is suspicious or risky;
- doing so is necessary to protect users, payment systems, carriers, support systems, rights holders, or marketplace integrity; or
- we are required or permitted to do so by law, court order, payment-provider rule, carrier rule, regulator, law-enforcement request, or other legal obligation.
Where appropriate, we may provide a statement of reasons and an opportunity to appeal. We may limit or withhold reasons or appeal opportunities where providing them would create legal, regulatory, security, fraud-prevention, safety, confidentiality, investigative, or anti-abuse risk, or where you have repeatedly breached these Terms.
If your account is suspended, restricted, or terminated, you must not create or use another account to avoid that action.
You may contact us at support@pcific.co.uk if you believe a restriction, suspension, takedown, or other enforcement action was applied in error. We may request additional information before reviewing the decision.
We may modify, suspend, withdraw, discontinue, or restrict any part of the Services at any time for operational, legal, security, technical, safety, compliance, or commercial reasons. We do not guarantee that the Services, or any part of them, will always be available, uninterrupted, secure, or error-free.
Privacy
Our handling of personal data is described in our Privacy Policy made available through the Services. By using the Services, you acknowledge that your personal data will be handled in accordance with the Privacy Policy.
Marketplace operation may involve processing personal data for account creation, verification, payments, shipping, messaging, listings, reviews, support, reporting, fraud prevention, safety, tax, VAT, legal compliance, analytics, AI-assisted tools, and dispute handling.
You must not use the Services to collect, publish, sell, scrape, misuse, or unlawfully disclose personal data about other users or third parties.
Intellectual Property
We or our licensors own all intellectual property rights in the Services, including software, code, databases, functionality, design, text, graphics, logos, trade marks, service marks, page layouts, tools, systems, and other materials made available by us through the Services, excluding User Content owned by users ("Our Content").
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended personal or internal business purposes.
You must not copy, scrape, reproduce, sell, license, republish, distribute, publicly display, reverse engineer, decompile, disassemble, adapt, or otherwise exploit any part of the Services or Our Content except:
- as expressly permitted by these Terms;
- as technically necessary to use the Services in the ordinary course; or
- where applicable law gives you a non-excludable right to do so.
You must not use PCIFIC's name, logo, trade marks, branding, design, screenshots, marketplace data, or content in a way that suggests endorsement, partnership, affiliation, or authorisation without our written permission.
If you send us ideas, suggestions, product feedback, or other feedback about the Services ("Feedback"), you retain ownership of any intellectual property rights you have in that Feedback. However, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free licence to use, copy, adapt, and incorporate that Feedback for the purpose of operating, improving, developing, and promoting the Services, without any obligation to compensate you.
Disclaimers
The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
In particular:
- listings, product descriptions, images, compatibility statements, condition grades, seller policies, verification materials, review content, and messages are usually supplied by users or third parties, not PCIFIC;
- AI-assisted outputs, search results, summaries, listing drafts, support suggestions, category suggestions, pricing suggestions, and similar tools may be inaccurate, incomplete, biased, out of date, or unsuitable for your circumstances;
- verification checks, badges, warnings, trust signals, review scores, seller signals, and search signals are screening and information tools only and are not guarantees;
- we do not guarantee that every item is genuine, lawful, safe, correctly described, available, fit for purpose, compatible, or free from third-party rights;
- we do not guarantee uninterrupted availability, error-free operation, or that the Services will always be secure or free from harmful components; and
- we are not responsible for delays, interruptions, outages, bugs, compatibility issues, carrier failures, payment-provider failures, third-party service failures, internet outages, cyber incidents, or user/device issues beyond our reasonable control.
Nothing in this section excludes any warranty, guarantee, duty, or right that cannot lawfully be excluded.
Limitations of Liability
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of rights or duties that cannot lawfully be excluded or limited; or
- any other liability that cannot lawfully be excluded or limited.
If you are a consumer
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when you accepted these Terms, both you and we knew it might happen.
We are not responsible to consumers for:
- loss or damage that was not foreseeable;
- loss or damage caused by your own breach of these Terms;
- loss or damage caused by a third-party seller's acts or omissions, except to the extent we are legally responsible for them;
- business losses, including loss of profit, loss of revenue, loss of business opportunity, loss of goodwill, loss of anticipated savings, business interruption, or loss of business data; or
- losses that could have been avoided by you taking reasonable steps.
Nothing in these Terms affects your non-excludable statutory rights.
If you are using the Services for business purposes
To the fullest extent permitted by law, we will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profit, loss of revenue, loss of sales, loss of goodwill, loss of reputation, loss of savings, loss of business opportunity, loss of data, business interruption, wasted expenditure, or third-party claims, whether arising in contract, tort, negligence, breach of statutory duty, misrepresentation, restitution, or otherwise.
Subject to the non-excludable liabilities listed above, our total aggregate liability to a business user arising out of or in connection with the Services, a transaction, or these Terms will not exceed the greater of:
- the total fees paid by that business user directly to PCIFIC in the 12 months before the event giving rise to the claim; and
- GBP 500.
Business User Indemnity
If you use the Services in the course of business, you agree to indemnify and hold harmless PCIFIC, its group companies, officers, directors, employees, contractors, agents, and service providers from and against losses, liabilities, damages, costs, expenses, claims, penalties, fines, and reasonable legal fees arising out of or in connection with:
- your listings, products, sales, services, returns, refunds, warranties, repairs, refurbishments, shipping, taxes, VAT, duties, customs, or business operations;
- your breach of these Terms or any applicable policy;
- your unlawful, unsafe, counterfeit, stolen, infringing, misleading, recalled, restricted, or non-compliant items;
- your User Content, messages, reviews, reports, support submissions, verification submissions, or evidence;
- your infringement or alleged infringement of any third-party rights;
- your breach of consumer, product-safety, advertising, tax, VAT, import, export, sanctions, environmental, data-protection, intellectual-property, or other laws;
- any dispute between you and a buyer, seller, rights holder, carrier, payment provider, regulator, tax authority, or other third party; or
- your fraud, negligence, wilful misconduct, or misuse of the Services.
If you are a consumer, you are responsible to us only for losses we suffer as a direct result of your breach of these Terms, and only where the law allows us to recover those losses from you.
Governing Law and Dispute Resolution
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of England and Wales.
If you are a consumer, you will also benefit from any mandatory protections of the law of the country in the United Kingdom where you are resident, and nothing in these Terms limits those protections.
If you have a complaint about the Services, please contact us first at support@pcific.co.uk. We will try to review and respond to genuine complaints in good faith.
Nothing in these Terms requires a consumer to submit a dispute to mandatory arbitration or prevents a consumer from bringing a claim in court where the law allows it.
If you are a consumer resident in England or Wales, you and we may bring claims in the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring claims in the courts of your part of the United Kingdom.
If you use the Services in the course of business, the courts of England and Wales will have exclusive jurisdiction over disputes arising out of or in connection with these Terms, subject to any mandatory law that says otherwise.
If we cannot resolve a consumer complaint through our internal process, we may provide details of an appropriate certified alternative dispute resolution ("ADR") entity and state whether we are willing, required, or not required to participate in that ADR process. Unless we expressly say otherwise or the law requires it, we are not obliged to participate in ADR.
Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version through the Services and, where required by law, take additional steps to notify you.
Changes will not apply retrospectively unless required by law. By continuing to use the Services after updated Terms take effect, you agree to the revised version.
If a change materially affects an ongoing transaction, claim, dispute, or paid service, we will take reasonable steps to apply the version or rules that are fair and legally appropriate in the circumstances.
Miscellaneous
These Terms, together with the Privacy Policy and any policies, guidelines, disclosures, or supplemental terms expressly incorporated by reference, form the entire agreement between you and PCIFIC in relation to the Services.
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remainder of the Terms will remain in force.
Our failure or delay in exercising any right under these Terms does not waive that right.
We may assign, transfer, or subcontract our rights and obligations under these Terms where permitted by law. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
Nothing in these Terms creates any agency, partnership, employment, fiduciary, franchise, or joint venture relationship between you and PCIFIC, except where we expressly state that PCIFIC acts as a disclosed intermediary or collection agent for a third-party sale.
You are responsible for keeping your own copies of any information, records, evidence, photos, listing data, messages, invoices, receipts, shipping records, tax records, or other material that matters to you. Subject to applicable law and our Privacy Policy, we may retain or delete data in accordance with our operational, legal, compliance, and retention needs.
By using the Services, sending emails, using online forms, opening support tickets, sending messages, creating listings, or completing electronic transactions, you agree to receive communications from us electronically where permitted by law. You agree that contracts, notices, disclosures, signatures, records, and other communications provided electronically satisfy any legal requirement that they be in writing, except where applicable law requires a different form.
